Is it too late to cancel my phone contract?

Ok so here’s there Return policy.

“Returns

If you bought your mobile online or via telesales:
If you're a new customer who bought your mobile via three.co.uk or from our own telesales team and for some reason you change your mind, provided you have not used your mobile, you can return it within 14 days of delivery. You’ll also have to return the original boxed accessories and documentation 'as new'.

This policy doesn't apply:

to new customers who did not buy their mobile via 3′s telesales team or via three.co.uk
to new customers who bought their mobile via 3′s telesales team who have used their mobile (this means that you may not personalise your mobile in any way, or use any of the 3 Services, or take photos or videos or load any data onto the mobile), or
to unfilled customers who choose (everywhere allowed by 3) to upgrade their mobile.
In all situation you must return your mobile to the retailer from which you bought it, along with the original boxed accessories and documentation ‘as new’. If you are unsure what to do or who to contact. Call 0843 373 3333 and we will advise you if you are eligible under this Returns policy and how to return your mobile and original boxed accessories. Always retain copies of your receipt and proof of postage. ”

(I also received a letter at the same time I got the phone saying I can turn on phone, check menu’s and options & look at the phone + accessories without damaging in anything)

Long tale small, I bought my htc disire hd from 3 ONLINE on a 24 month plot (£40 per month) contract. The phone came now, i opened the box, opend the charger ( in order to charge the phone I am aloud to “turn on”) played around with the phone for a few minutes and immediately regretted the whole contract :l

Note: the phone, box and accessories is still in perfect condition!

If you didnt make any calls on the phone…it is “unused” in their terms…
I would say your qualified for a return.

You can cancel if you say your signal is rubbish and is not how your adverts say they are. Say you can hardly make phone calls and it isnt a excellent enough network then they will have to cancel your contract.

If you change your mind then as it says you can return it. It doesnt matter that you opened the charger, just make sure that it is all there and that you have all of the documentation so your proof of order and everything. If you take it to a 3 store they should be able to help you there, or at least get you on the phone to cust. services without the annoying recorded menus.
